Article 1: Purpose and scope of application

These general terms and conditions of sale apply to all sales concluded on the website: shop.mawaqit.net.

These General Terms and Conditions of Sale (GTCS) form the basis of commercial negotiations and are systematically sent or given to each purchaser to enable them to place an order, or failing that, posted on the MAWAQIT website.

The general terms and conditions of sale described below detail the rights and obligations of MAWAQIT and its customer in connection with the sale of products.

Acceptance of the quotation/order form, including the clause “I acknowledge that I have read and accept the attached general terms and conditions of sale”, implies the buyer’s unreserved acceptance of these general terms and conditions of sale.

Article 2: Prices

The prices of the goods sold are those in force on the day the order is taken. In accordance with article 293 B of the French General Tax Code, VAT is not applicable to products sold on the website. However, the product prices shown do not take into account any potential additional delivery charges. The final price, including delivery charges, will be displayed at the time of payment.

MAWAQIT reserves the right to change its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

Article 3: Discounts and rebates

The prices quoted include any discounts and rebates that MAWAQIT may grant on the basis of its results or the buyer’s assumption of responsibility for certain services.

Article 4: Discount

No discount will be granted for early payment.

Article 6: Software updates

Digital products purchased on the MAWAQIT site or on a third-party site may be subject to updates. These are specified on the product page at the time of purchase, and may also be required by law to ensure compliance. Additional updates, offering new functionalities, designs, interfaces and/or features or making minor technical modifications may also be offered by MAWAQIT or a third party. By accepting the conditions of sale, you agree to these updates, which will be made automatically without any action on your part. Manual updates, on the other hand, must be installed by you, and failure to do so correctly or on time may affect product performance or functionality.

Article 7: Complaints

To make a claim, please contact us by e-mail at the following address: [email protected]. We will provide you with instructions on how to return the product for a refund.

If the product is defective or does not correspond to the description provided on our site, you can return the product to us and we will give you a full refund.

Please note that claims must be made within 30 days of receipt of the order. After this period, we will no longer be able to accept complaints.

Article 8: Withdrawal

The customer has 14 days from receipt of the product to exercise his right of withdrawal without having to justify his decision or pay any penalties.

Article 9: Return and refund conditions

We are committed to providing you with quality products and ensuring customer satisfaction. If for any reason you are not satisfied with your purchase, we offer you the possibility to return it under the following conditions:

  1. Return period : You have 14 days from receipt of your order to return the product for a refund or exchange.
  2. Return conditions: Products must be returned in their original condition, unused, undamaged and in their original packaging. We recommend that you return them with proof of purchase and an explanation of the reason for the return.
  3. Return shipping costs: You are responsible for return shipping costs, except in the case of product non-conformity or incorrect delivery.
  1. Refunds: Refunds will be made as soon as possible and at the latest within 14 days of receipt of the returned product. The refund will be made by the same means of payment used for the original purchase.
  2. Exchange: If you wish to exchange a product, please contact us to inform us of your wish and the reason for the exchange. We will process your request as quickly as possible.

MAWAQIT will not be held responsible for any damage resulting from abnormal or abusive use of the product.

Article 10: Delivery

The delivery time indicated when the order is placed is given as an indication only and is in no way guaranteed, as factors beyond MAWAQIT’s control may influence the delivery time.

Consequently, any reasonable delay in the delivery of the products shall not give rise to :

Transport risk is borne entirely by the buyer. If goods are missing or damaged in transit, the purchaser must make all necessary reservations on the order form upon receipt of said goods.

Article 11: Fractional or deferred payment

No fractional or deferred payments will be granted.

Article 12: Retention of title clause

The MAWAQIT association retains ownership of the goods sold until full payment of the price, in principal and in accessories. In this respect, if the purchaser is the subject of receivership or liquidation proceedings, MAWAQIT reserves the right to reclaim, within the framework of the receivership proceedings, the goods sold and remaining unpaid.

Article 13: Force majeure

MAWAQIT shall not be held liable in the event of non-performance or delays in the performance of its obligations described in the general terms and conditions of sale due to force majeure. Unforeseeable, unavoidable and irresistible events, as defined by article 1148 of the French Civil Code.

Article 14: Jurisdiction

Any dispute relating to the interpretation and execution of these terms and conditions of sale shall be governed by French law. Failing amicable resolution, the dispute will be referred to the Paris Commercial Court.
